Appendix to General Terms and Conditions
General basis
The following document outlines the LiveXP Subscription Terms and Conditions (the “Terms”), which cover basic regulations regarding pricing, payments, available actions, and deadlines for making them towards Subscriptions purchased at LiveXP, by students.
These Terms should be read alongside with and in an addition to LiveXP policies, including Subscription Cancellation and Refund policy, Lesson Terms and Conditions, General Terms and Conditions, as well as all other policies and rules published on the LiveXP website.
The following Terms apply to ensure the comfortable provision of services and to avoid possible misunderstandings.
In these Terms, references to “We” or “Us” are toLiveXP Learning Ltd, and “You” or “Your” are references to you as a Student.
Subscription definition
- A subscription is a recurring payment that grants you a set amount of lessons and access to all features on LiveXP.
- Subscription is essentially an auto-renewable lesson package. The Subscription renewal date is always visible in your profile menu and in the most recent Subscription payment confirmation email. We send it to you after your most recent payment.
- Subscription is not "assigned" to a specific tutor or a specific language. You can have every single lesson with any tutor you want. You are free to choose if you want to stick to one tutor or change the tutor or the language you learn at any time. You can learn different languages or one language with different tutors at the same time.
Subscription plans
Subscriptions are available for:
- 4 weeks (“Monthly Subscription”)
- 12 weeks (“Quarterly Subscription”)
Within both Subscription plans students can choose:
- Lesson duration: 30, 45, 60 minutes
- Lesson frequency: 1, 2, 3, 4, or 5 lessons per week
Subscription price
The Subscription price depends on:
- Subscription period
- Lesson duration
- Lesson frequency
- Ongoing promotional campaigns (if any)
- Personal introductory discount (if any)
- When you choose a Subscription plan, the price will be automatically calculated and displayed on the screen before you confirm the payment.
- We reserve the right to change the price of the Subscription plans at any time subject to notifying you in advance, but no later than 7 (seven) calendar days before the next renewal date. If you do not wish to continue with the current Subscription, you can switch to another plan or cancel it according to Subscription Cancellation and Refund policy.
Subscription payments
When you subscribe, you authorise us to:
- Save the payment details you entered last
- Automatically charge your saved payment method the price of your Subscription when the current Subscription billing period ends
- Even if you paid for your previous or first Subscription with a discount, we can charge your saved payment method the full Subscription price (without a discount).
- You can get information about your next billing date and next payment amount through the profile menu.
Subscription lessons
- Your lesson balance is visible in the profile menu.
- After each Subscription payment, including the first and all renewal payments, you will get a lesson package. The number of the lessons added to your balance depends on your current Subscription plan.
- If a scheduled lesson is low quality or does not happen, such lesson will be returned to your Subscription balance. Please familiarize yourself with the full Lesson Terms and Conditions.
- If you do not use all the lessons that you have on the balance until the next billing period, you keep them and can schedule them anytime within 1 (one) year.
- Having lessons left on your balance does not cancel the next rebill. In this case, the Subscription renewal charge happens as normal, you receive a lesson package to the balance according to your Subscription plan. If you do not need more lessons, you need to cancel the Subscription before the rebill date.
- If you cancel the Subscription, you get to keep all your remaining lessons even after your Subscription ends. You can continue to schedule them as usual.
- The unused lessons will be lost and/or cancelled after 1 (one) year from the date of the purchase of the said lessons. For the avoidance of any doubt, you can only use any purchased lessons within the period of 1 (one) year from the date of the purchase.
Subscription cancellation by a Student
- Subscriptions automatically renew unless cancelled.
- You can cancel any active Subscription anytime. If you cancel any Subscription, previous charges will not be refunded, but new charges will not be applied.
- To know when your Subscription renews/ends, see the most recent Subscription payment confirmation email. We send it to you after your most recent payment.
- The Subscription can be cancelled either through your account or by the Support team. To keep the remaining unused lessons, cancel the Subscription through your Profile settings.
- If the Subscription is cancelled by the Support team, the remaining unused lessons will be removed from your balance. To keep your unused lessons, schedule them before contacting the Support team.
- Your cancelled Subscription ends at the end of your current billing period.
- You can always restore the cancelled Subscription before the end of the current billing period. You can do it from your profile settings.
- It is your responsibility to familiarize yourself with the full Subscription Cancellation and Refund policy before purchasing any Subscription.
Subscription termination by LiveXP
We reserve the right to end your Subscription at our discretion if:
- You do not schedule any of the purchased lessons before the next rebill date
- You neither attend scheduled lessons nor cancel/reschedule them
- You do not reply to our requests for clarification through the LiveXP messenger and/or email
- Before we end your Subscription due to any of the reasons above, we contact you through the LiveXP messenger and/or email to get the final clarification from you.
- If at any point you lose your rights to use LiveXP because you break these Terms or any other policies in the section “General basis” of these Terms, your active Subscription also ends.
- If we end your Subscription due to the points 1-3 of this section, you are not entitled to a refund.
Subscription management
Changing a Subscription plan
- You have the option to change an active Subscription plan through your profile settings anytime.
- When you change your Subscription plan, your remaining unused lessons will be converted into a discount which will be applied to the first new Subscription payment. The already scheduled lessons are considered “used” and are not converted into a discount.
- All remaining unused lessons from your current Subscription will be removed, and new lessons will be added to your balance.
- In any case if the Subscription plan you want to switch to costs less than your current remaining unused lessons, then you need to schedule all remaining unused lessons with any Tutor before you change your plan. Your lesson balance before a plan switch in this case should be zero.
- When you are in the process of changing your Subscription plan, the price is automatically calculated and displayed on the screen before you confirm the payment.
- If you pay for the new Subscription plan, your current Subscription ends, and new Subscription lessons will be added to your balance.
- The number of new lessons is determined by a Subscription plan you switch to.
- When you switch to a new Subscription plan, you do not buy additional lessons, but you sign up for a new Subscription plan by cancelling the current one and removing the remaining unused lessons from your balance. Once the Subscription plan is changed, the number of available lessons for you is updated.
- After you pay for the new Subscription plan, you get a payment confirmation email with Subscription details, next rebill date, and the next Subscription payment amount.
Subscription plan refill
- If you have an active Subscription and you spend all your lessons (schedule and have them with any Tutor) before the next Subscription rebill date, you can refill your Subscription balance earlier.
- You can refill the current Subscription balance through your profile settings only when you run out of lessons, as is stated in the point above.
- If you refill the balance, you get the same number of lessons with the same duration as you had before. Your Subscription plan does not change. The only thing that changes is the rebill date.
- When you proceed with the Subscription rebill, your saved payment details are charged with the price of your current Subscription plan, and new lessons are added to your balance.
- After the payment, you get a payment confirmation email with a new rebill date and Subscription details.
Paying for a new Subscription plan
- If you have never had a Subscription, you can always buy it through your profile settings.
- If you have previously had a Subscription, and it was deleted, you can always buy a new Subscription through your profile settings.
- When you buy a new Subscription and if you have remaining lessons from your previous inactive Subscriptions, those remaining unused lessons are converted into a discount which will be applied to the first new Subscription plan payment. The already scheduled lessons are considered “used” and are not converted into a discount.
- All remaining unused lessons you have from your previous inactive Subscriptions are removed, and new lessons are added to your balance.
- The number of added lessons is determined by a new Subscription plan.
- In any case if the Subscription plan you want to switch to costs less than your current remaining unused lessons, then you need to schedule all remaining unused lessons with any Tutor before you change your plan. Your lesson balance before a plan switch in this case should be zero.
- After you pay for the new Subscription plan, you get a payment confirmation email with Subscription details, next rebill date, and the next Subscription payment amount.
